These Membership Terms and Conditions (“Agreement”) govern the membership in the Whiskey Collective, LLC. Please read this Agreement carefully.
Introduction
These Terms and Conditions apply to your membership to the Whiskey Collective, LLC (the “Collective”), and govern the relationship between you, the member (the “Member”), and the Collective. By applying for membership to the Collective, the Member agrees to be bound by these Terms and Conditions.
MEMBERSHIP TERMS
Membership
Eligibility: Membership to the Collective is open to individuals who are at least 21 years of age and who are legally allowed to purchase and consume alcoholic beverages in their respective jurisdictions.
Application: To apply for membership, the Member must provide accurate and complete information through the Collective’s online registration form.
Approval: Membership is subject to the Collective’s approval, which may be granted or denied at the Collective’s sole discretion.
Membership Type: The Collective currently offers one membership level, which provides one quarterly shipment of whiskey samples delivered to the Member’s address. The Collective reserves the right to change the shipment date, which may fluctuate slightly depending on availability and shipping logistics.
Membership Fees: Membership fees are non-refundable and are subject to change at the Collective’s discretion. The Member will be notified in advance of any changes to the membership fees.
Shipment Fees: Members agree to keep their payment information up-to-date and accurate. Whiskey Collective, LLC reserves the right to suspend or cancel a membership if payment information is not current or if a payment is declineMembers are responsible for any fees associated with a declined payment or chargeback. By signing up for a membership, members authorize Whiskey Collective, LLC to charge their chosen payment method for the shipment fee and any applicable taxes, shipping costs, or other charges associated with their shipment.
Gifting: Memberships may be purchased as a gift for another individual. If a subscription is given as a gift, the receiving party must abide by the terms of these conditions. Gift memberships that are unused will be forfeit after 2 years.
Benefits and Privileges
Whiskey Samples: The Collective will deliver a selection of whiskey samples to the Member’s address once every quarter. The Member agrees to provide accurate and complete shipping information, and to ensure that someone who is at least 21 years of age is present to receive the delivery.
Events and Tastings: The Collective may organize events and tastings for Members, subject to availability and capacity.
Feedback and Influence: Members will have the opportunity to provide feedback on the whiskey samples they receive, which will directly impact the direction of the final whiskies that will be made available initially to Members.
Members have access to a members-only website, and other special offers, discounts, and promotions as determined by Whiskey Collective.
Responsibilities and Obligations
Compliance with Laws: The Member agrees to comply with all applicable laws, regulations, and policies related to the purchase, possession, and consumption of alcoholic beverages.
Responsible Consumption: The Member agrees to consume alcohol responsibly, and to not drive or operate machinery while under the influence of alcohol.
Termination: The Collective reserves the right to terminate the Member’s membership at any time and without notice, if the Member breaches these Terms and Conditions or if the Collective believes that the Member’s behavior is detrimental to the Collective or to other Members.
Cancellation and Termination
Cancellation: Members may cancel their membership at any time by accessing their online profile and following the cancellation process. If orders have already been processed for the upcoming quarterly shipment and the shipment cannot be stopped, the Member will be charged for that shipment and will not be eligible for a refund. The membership fee is non-refundable.
Termination: The Collective may terminate a Member’s membership if the Member breaches these Terms and Conditions, violates any applicable laws or regulations, or engages in conduct that the Collective deems harmful to its business, reputation, or other Members. In such cases, the Collective will provide the Member with notice of termination and the reason(s) for termination.

Refunds
Refunds cannot be given once a product is shipped in accordance with liquor selling laws. If there is a damaged or missing shipment that was not due to availability of a resident, members must follow the process outlined in their member profile. Whiskey Collective and its partners (including retailers) have built the taxes into the sale price of products. Whiskey Collective works with retail locations and each retail location may have their own limits for returns and refunds, and Whiskey Collective will do everything it can in accordance with the law to ensure members are satisfied.
Shipment and Delivery
Shipment: The Collective distributes its products through a wide network of retail locations that have the capability to ship to residential addresses. The Member acknowledges and agrees that shipments may come from different parts of the country depending on factors such as state and local laws, licensing requirements, inventory availability, and other logistical considerations.
Prohibited Resale: Members agree not to purchase Collective products for the purpose of resale or to distribute them to any third parties for the purpose of resale.
Delivery: The Collective will make its best efforts to deliver the quarterly shipments in a timely manner. The Member or an authorized individual who is 21 years of age or older must be available to receive the shipment and provide proof of age to the carrier service. The Collective is not responsible for any shipment that is returned or delayed due to the unavailability or failure of the Member or an authorized individual to provide proof of age.
By agreeing to these Terms and Conditions, the Member acknowledges and agrees that the Collective distributes its products through a wide network of retail locations that have the capability to ship to residential addresses, and that the Member or an authorized individual who is 21 years of age or older must be available to receive the shipment and provide proof of age to the carrier service. The Member also acknowledges that shipments may come from different parts of the country depending on factors such as state and local laws, licensing requirements, inventory availability, and other logistical considerations, and that delivery dates may fluctuate due to factors beyond the Collective’s control.
Pricing and Taxation
Price Inaccuracies: Whiskey Collective, LLC reserves the right to cancel any order or membership in the event of an obvious pricing or product description inaccuracy. If an error is discovered, we will make reasonable efforts to correct it promptly. However, we do not guarantee that all errors will be correcteIf an order is canceled, we will make reasonable efforts to notify the affected member and issue a refund for any payments already made.
Taxation: Whiskey Collective, LLC and its partners, including retailers, have built applicable taxes into the sale price of products. Members are responsible for any additional taxes or fees associated with their membership or orders that may be imposed by their state or local government. Members agree to comply with all applicable tax laws and regulations, including those related to reporting and payment of taxes.
Giveaways
Giveaway opportunities are available to anyone and no purchase is necessary. If you would like to be considered for a giveaway, please send a message to marketing@whiskey-collective.com with the subject line: Whiskey-Collective Giveaway Entry. In the body of the email include your full name, address, and phone number along with the giveaway you are wanting to be considered for. All submissions must be submitted 45 days prior to the giveaway date to be considered.
Privacy
Whiskey Collective, LLC respects the privacy of our members and is committed to protecting their personal information. Any personal information collected during the course of a membership or order will be used solely for the purpose of fulfilling the membership or order and communicating with the member. We will not share, sell, or rent any personal information to third parties, except as necessary to fulfill the membership or order. By joining Whiskey Collective, LLC, members consent to the collection, use, and disclosure of their personal information as described in our privacy policy.
Intellectual Property
All content on the Whiskey Collective, LLC website, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of Whiskey Collective, LLC or its content suppliers and is protected by United States and international copyright laws. Members agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes any portion of the Whiskey Collective, LLC website or any of its services. Members may share information about the website through social media or other means, but must not misrepresent or misappropriate the Whiskey Collective, LLC brand or intellectual property.
General Provisions
Amendment: These Terms and Conditions may be updated by the Collective from time to time without notice to the Member. The Member acknowledges and agrees that it is their responsibility to review this page periodically to ensure that they are aware of any updates. The current version of the Terms and Conditions will be posted on this page.
Notification: The Collective reserves the right to notify Members of any significant changes to these Terms and Conditions, in its sole discretion. The Member acknowledges and agrees that such notification, if provided, will be made to the email address on file with the Collective.
Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Missouri.
Entire Agreement: These Terms and Conditions constitute the entire agreement between the Member and the Collective, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the Member and the Collective with respect to the subject matter of these Terms and Conditions.
DISCLAIMERS OF WARRANTY AND LIMITATION OF LIABILITY:
THE SERVICE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE ARE PROVIDED BY WHISKEY COLLECTIVE ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. WHISKEY COLLECTIVE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE FULL EXTENT PERMISSIBLE BY LAW, WHISKEY COLLECTIVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WHISKEY COLLECTIVE DOES NOT WARRANT THAT THE SERVICE; INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE; THEIR SERVERS; OR E-MAIL SENT FROM WHISKEY COLLECTIVE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WHISKEY COLLECTIVE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SERVICE OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.
